1. Agreement to Terms

By accessing or using WitCraft ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

WitCraft is a personalized reality remix platform. You upload a photo, and the Service uses AI image generation to place you inside a scene you choose — stadium selfies, host-city moments, fan celebrations, and other aspirational visuals. Generated images are creative, fictional compositions made for fun and sharing; they are not photographs of real events.

WitCraft is not affiliated with, endorsed by, or sponsored by FIFA or any tournament, league, club, or athlete. Scenes are tournament-inspired and feature fictional player archetypes only.

While we strive for quality, the Service is provided for entertainment purposes only, and we make no guarantees about the accuracy, reliability, or appropriateness of the generated content.

3. Your Photos and Content

By uploading a photo, you represent and warrant that:

• You own the photo or have the rights necessary to upload it
• You have the consent of any other identifiable people pictured in it
• The photo does not contain unlawful, harmful, or infringing content

You retain ownership of the photos you upload. You grant us only the limited license needed to store and process them to provide the Service.

4. Generated Images

For images generated from your photo, you receive a personal, non-exclusive license to use them for personal, non-commercial purposes — download them, share them, post them.

You agree not to use generated images to:

• Deceive, defraud, or mislead others — including presenting a generated image as an authentic photograph of a real event
• Impersonate any person or claim a real affiliation, attendance, or endorsement that did not occur
• Harass, abuse, defame, or harm others

Generated images may carry a small "Created with WitCraft" disclosure during beta.

5. User Responsibilities

You agree to:

• Provide accurate information when using the Service
• Use the Service only for lawful purposes
• Not use the Service to harass, abuse, or harm others
• Not attempt to gain unauthorized access to the Service
• Not use the Service for commercial purposes without permission

6. Payments, Tokens, and Refunds

The Service is sold as one-time token packs. Each scene generation uses one token. Tokens never expire. By making a purchase, you agree to pay the specified amount. All payments are processed securely through Stripe.

Due to the immediate delivery nature of our digital products, we generally do not offer refunds unless required by law or at our discretion.

7. Intellectual Property

The Service and its original content (excluding photos you upload and images generated from your requests) are and will remain the exclusive property of WitCraft and its licensors.

8. Deletion

You may request deletion of your uploads, your generated scenes, or your entire account at any time by emailing support@witcraft.ai. See our Privacy Policy for details on how your data is handled.

9. Limitation of Liability

WitCraft shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
